The Conflict Decoded Occupation, apartheid and genocide law October 31, 2026 Markdown version

Can a long occupation become apartheid?

Yes, a long occupation can become apartheid when it stops being a temporary security measure and hardens into permanent, institutionalized domination of one people by another — which is precisely what international-law experts, UN investigators, and even many Israelis say has happened in the West Bank.

The definition of apartheid under international law

The definition of apartheid under international law is precise and applies to any state, anywhere. The 1973 International Convention on the Suppression and Punishment of the Crime of Apartheid — the first treaty definition — and the 2002 Rome Statute define apartheid as inhumane acts committed in the context of an institutionalized regime of systematic oppression and domination by one racial group over another, with the intent to maintain that domination. This legal definition binds every state party to the treaties. It is a crime against humanity, not a rhetorical slur reserved for South Africa (Human Rights Watch1).

UN reports: Israel’s occupation is apartheid

The UN’s own findings are unambiguous. On 25 March 2022, the UN Special Rapporteur for the occupied Palestinian territory, Michael Lynk, declared in Geneva: “Israel’s 55-year occupation of Palestinian Territory is apartheid” (OHCHR2). His report to the Human Rights Council, A/HRC/49/87, concluded that 5 million stateless Palestinians live under one apartheid regime: 700,000 settlers under Israeli civil law, their Palestinian neighbors under military decrees, with settler-only roads and movement restrictions (A/HRC/49/873). UN investigators called on the international community to accept the findings.

A genuine military occupation, even a long one, can be lawful if temporary and conducted under the Hague and Geneva rules. Apartheid begins when the occupier settles its own civilians permanently, denies the population any path to self-determination, and governs two peoples under two different legal systems — the comparison scholars John Dugard and John Reynolds draw with South Africa (EJIL4). In 2021 Human Rights Watch concluded Israel commits the crimes against humanity of apartheid and persecution under a policy of maintaining Jewish-Israeli domination (HRW, “A Threshold Crossed”1); in 2024 the International Court of Justice found the occupation breaches the treaty prohibition on racial segregation.

Why the security framing fails

It is true, as the Israeli government argues5, that the charge is “factually and morally inaccurate” — and a temporary occupation truly would be. But security does not explain why the “temporary” occupation is the longest in modern history, why settlement never pauses, or why Israel’s own former ambassador to South Africa, sitting Knesset members, and Ehud Barak warned of an apartheid reality. Naming apartheid is not an attack on Israel’s existence — it is a call to end the long-term domination before it destroys both peoples’ future.
